The problem began when he used his Vol. FD blue lights to get the vandals. Indiana Law clearly defines the use of the blue light by vol. fire personal and the criminal charges that can be filed for the mis-use of the lights. I'm a FIRM believer in good old street justice and the right to make citizens arrests. At the Law Enforcement academy we were taught not to stress to the public that they do have the right to detain someone who has committed a crime until the proper authorities arrive. If he had detained them at the scene or followed them while calling the police he would have had no problems.
The officer would have just taken the suspects into custody, done a report and listed the gentleman as a witness to the crime. Unfortunately in some cases justice isn't blind and most likely because the blue light privilege and law was abused the suspects could possibly go free and the victim will be stuck with his own set of legal problems.. As I said before I don't always see eye to eye with the prosecutors office on their judgment calls!
For those who are thinking about using the "citizens arrest privilege" keep in mind you can not use force to detain someone unless the have committed a serious felony and they are a flight risk. You take a risk of being injured or even worse by trying to act and not waiting for the police. Also with today's "I can sue for any reason attitude", you've opened yourself up for a lawsuit if the case is lost in court or undue force is used. The best scenario is call the police, get a veh. or the persons description, a plate number and do not pursue the suspect at high speeds or recklessly. If you follow a suspect stay back, be inconspicuous and never, never try to make a traffic stop! ALWAYS CALL 911, DON'T BE A HERO!!!
